Franklin County grand jury hands down 108 indictments against 40 residents

FARMINGTON – A Franklin County grand jury indicted 40 individuals on a total of 108 charges during a session held Aug. 19 and Aug. 20.

An indictment means that after considering the evidence a district attorney has presented, a grand jury believes there is probable cause, or a “reasonable belief” that the crime occurred. A grand jury of up to 23 people need not be unanimous and does not need to be convinced beyond a reasonable doubt like a regular trial jury.

Alan M. Burnell, 19, of Livermore Falls, was indicted on a Class C unlawful sexual contact charge in an incident that allegedly occurred on May 26 that involved sexually touching another student while returning home on a school bus.

According to police, the case involves a student under the age of 14 years old who reported it to her school’s nurse. The nurse then notified the school’s guidance counselor and after speaking with the girl, contacted Spruce Mountain High School Principal Thomas Plourde, who then called the Jay Police Department.

Other residents indicted are:

Samantha K. Benvie, 27, of Charlton, Mass., was indicted on charges of Class B burglary, Class E theft and Class D criminal mischief.

Rebekah J. Brown, 44, of Farmington, was indicted on a charge of Class C domestic violence assault.

Eugene Burnell, 33, of Wilton, was indicted on a Class C charge of domestic violence terrorizing.

Derek S. Campbell, 29, of Wilton, was indicted on a charge of Class C domestic violence assault.

Gary L. Choate, Jr., 28, Jay, was indicted on two charges of Class C theft.

Jennifer L. Clifford, 29, Sandy River Plantation, was indicted on a charge of Class C theft.

Brian A. Dalot, 28, of Wilton, was indicted on charges of Class B aggravated assault, Class D domestic violence assault, and Class D domestic violence terrorizing.

John Ellis, 69, of Dixfield, was indicted on charges of Class B unlawful trafficking of schedule drugs, two charges of Class E violation of condition of release and Class D and E charges of unlawful possession of drugs.

Arion P. Emery, 32, of Farmington, was indicted on charges of Class A aggravated assault, Class C domestic violence assault.

David J. Engler, 31, Farmington, was indicted on a charge of Class C possession of a firearm by a prohibited (person).

Theodore J. Fischer, 26, of Chesterville, was indicted on charges of Class B burglary, Class D unsworn falsification and Class E theft.

Jeremiah D. Grant, 33, of Berwick, was indicted on charges of Class C eluding an officer, Class D reckless conduct and Class D endangering the welfare of a child.

Ryan M. Haggan, 26, of Farmington, was indicted on charged of Class B aggravated assault and Class D domestic violence assault.

Timothy L. Hutchinson, 29, of New Sharon, was indicted on two Class C charges of violation of bail conditions, and a Class D assault charge.

Jacob E. Jackson, 23, of Carthage, was indicted on charges of Class C eluding an officer, Class D operating under the influence, Class E operating beyond license condition and Class E criminal speed.

Christopher M. Labbe, 43, of Dixfield, was indicted on charges of Class C aggravated criminal mischief, Class E failure to stop for an officer, and Class E driving to endanger.

Richard G. Mealey, 43, of Farmington, was indicted on charges of Class B aggravated assault and Class D domestic violence assault.

Devin M. Medcoff, 21, Jay, was indicted on a charge of Class B aggravated assault.

Dakota M. Paul, 21, of Jay, was indicted on a charge of Class C unlawful possession of scheduled drugs (heroin).

Peter E. Richard, 29, of Farmington, was indicted on charges of Class B burglary, Class E theft and Class C unlawful possession of scheduled drugs (oxycodone).

Joshua H. Rinaldi, 34, of Livermore Falls, was indicted on charges of Class C aggravated operating after habitual offender revocation and Class D criminal operating under the influence.

Tracy A. Robbins, 40, of Rumford, was indicted on charges of Class C theft and Class E violation of condition of release.

Kevin M. Smith, 18, of Kinfield, was indicted on charges of Class C reckless conduct with a firearm and Class D terrorizing.

Richard E. Stenson, III, 23, of Lewiston, was indicted on a charge of Class C theft.

Justin T. Turner, 32, of Farmington, was indicted on charges of Class C domestic violence assault, Class D obstructing the report of crime or injury and Class D criminal operating under the influence.

Jason D. Velez, 36, of Wilton, was indicted on a charge of Class C domestic violence assault.

Guner A.K. Vicelich, 27, of Jay, was indicted on a charge of Class C assault.

Troy J. Walther, 32, of Anson, was indicted on charges of Class C criminal operating under the influence and Class E operating beyond license condition.

Robert A. Whittemore, 64, of Jay, was indicted on charges of Class C criminal operating under the influence and Class E operating after suspension.
